Salvato represents and warrants to the buyer of a vehicle purchased through Salvato’s platform that:

  1. The following information provided on the platform is accurate as of the time the buyer picks up the vehicle:
    1. year, make, and model;
    2. for vehicles less than 10 years old, current odometer reading (within 500 miles);

  2. The pictures of the vehicle provided on the platform are accurate as of the date buyer picks up the vehicle (provided that, while Salvato makes significant efforts to accurately display the colors and other components of images accurately, the actual presentation of any images and colors you see will depend on your monitor or the screen from which you are viewing the platform and Salvato does not guarantee that your device will display pictures or colors accurately);

  3. Buyer or buyer’s authorized representative will have the option to pick up the vehicle during the times listed on the platform at the time of buyer’s purchase of the vehicle; and

  4. The title provided to the buyer will match the title state and title type listed on the platform, the title will be free and clear of any liens, and the buyer will have the option to have the title re-assigned to them, excluding Non-Repairable Titles which cannot be re-titled in the United States and subject to any other exclusions under applicable law.

Notwithstanding the foregoing, Salvato makes no representations or warranties regarding buyer’s ability to register or export a vehicle or regarding the condition of the vehicle. The Salvato Buyer Promise does not cover cosmetic damage (such as paint or rust on the vehicle exterior), damage that would not be visible in the picture of vehicles provided on the platform, damage that occurred after the vehicle was picked up by the buyer or buyer’s authorized representative, or claims caused or otherwise impacted by activities undertaken by or on behalf of a buyer or a buyer’s representative in response to a claim that are not expressly authorized under this policy or requested by Salvato in writing.

This policy sets forth Salvato’s exclusive warranties regarding vehicles purchased through the Salvato Platform. In the event a buyer believes in good faith that Salvato has failed to meet the Salvato Buyer Promise, buyer must submit a claim in accordance with this policy. All claims are subject to the terms and requirements of the Salvato Buyer Promise and the Salvato Terms of Use at https://www.SalvatoInc.com/Terms-of-Use. Salvato will use commercially reasonable means to assess any claims submitted under the Salvato Buyer Promise. In the event Salvato determines that the conditions of the Salvato Buyer Promise are not met in accordance with the terms hereof, buyer’s exclusive remedy and Salvato’s exclusive liability shall be for Salvato to take ownership of the vehicle and refund the full amount paid by the buyer for the vehicle, including the Vehicle Auction Price, Buyer Fee, and any other applicable fees paid to Salvato. In no event shall Salvato’s liability to the buyer under the Salvato Buyer Promise exceed the amount paid by the buyer to Salvato for the vehicle, including the Vehicle Auction Price, Buyer Fee, and any other applicable fees paid to Salvato.

Claims made under the Salvato Buyer Promise are subject to the following eligibility requirements:

  1. Claim must be filed before the applicable deadline listed below
  2. Buyer’s Account with Salvato must be in good standing at the time the claim is filed
  3. Vehicle must still be located within the United States
  4. Vehicle must be returned to the location where it was picked up by the buyer or buyer’s authorized representative within 10 days of filing the claim, so that damage can be verified by Salvato
  5. Buyer must provide all photos and other documentation to support the claim within 10 days of filing the claim

Salvato retains sole discretion to administer this policy, evaluate the legitimacy of claims, and determine the eligibility of any individual buyer. The exclusive remedies under this policy apply only to buyers registered as users on the Salvato Platform in good standing and cannot be assigned or transferred to any third party. Sale or other transfer of a vehicle by a buyer shall void the terms of this policy.

Claims must be submitted before the following deadlines, as measured from the time when the vehicle is picked up by the buyer or buyer’s authorized representative. Failure to make a claim in writing in accordance with this policy prior to the deadlines below will constitute buyer’s waiver of the claims under this policy:

  • Year, Make, Model, or Odometer Reading: within 72 hours
  • Pictures: at time of vehicle pick-up
  • Option to pick up vehicle during times listed on the platform: within 24 hours of attempted vehicle pick-up
  • Title State and Title Type: within 90 days
  • Liens: within 90 days
  • Option to have the title re-assigned: within 90 days

Claims must be submitted to Salvato’s Buyer Support.
